2. Object and scope

These General Conditions of Sale apply to any transactions of a commercial nature carried out through the Books Market online store available at booksmarket.pt.

The purchase of any title on the Books Market implies acceptance of these General Conditions of Sale by the User and Customer.

The Books Market. reserves the right to change these General Sales Conditions without prior notice, any changes being immediately published on the online store.

3. Content information

Reproduction, transfer, distribution or storage of the contents of the Books Market page without prior written permission is strictly prohibited.

Books Market reserves the right to modify at any time the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.

It is expressly forbidden to introduce links, regardless of the intended purpose.

Every effort has been made to ensure that the information presented herein is free from typographical errors and whenever these occur, Books Market will correct them as soon as possible.

The photographs presented on the Books Market page are merely illustrative.

Books Market is not responsible, directly or indirectly, for any information, content, statements or expressions contained in the texts of commercialized books. The authorship of the content of the descriptions of the books is the responsibility of the publishers of the books in question.

If the information presented does not correspond to the actual characteristics of the product, the Customer has the right to terminate the purchase and sale contract under the applicable legal terms.

4. Intellectual and industrial property

Any total or partial reproduction or representation of the Books Market page or all or part of the elements included therein is strictly prohibited, under penalty of recourse to the competent legal means against those who act in this way.

Company names, brands, as well as any distinctive signs reproduced on the Books Market website or Facebook page are protected under the legal provisions applicable to industrial property. Reproduction or representation of all or part of these distinctive signs is strictly prohibited and must be subject to prior written permission from the respective holders.

5. Responsibilities

All books sold on the Books Market page are in compliance with Portuguese legislation, namely the Fixed Book Price Law .

6. Obligations of Customers and Users

Customers undertake to comply with and respect these General Sales Conditions, namely:

  • Refrain from introducing, storing or disseminating through the Books Market website defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order;

  • Not to use false identities;

  • To provide personal data and the correct addresses so that orders can be properly and correctly processed.

It is thus expressly prohibited for its users to transmit messages or information that is insulting, misleading, defamatory, obscene or that violates, in any way, the right to privacy or intellectual or industrial property of third parties, as well as the provision of any information that may be harmful to third parties or the owner of the page.

The Customer is responsible for the veracity of the data communicated on the Books Market online store.

Books Market declines any responsibility for any delay or impossibility of processing the order, namely in the act of delivery, due to error or insufficiency of the data communicated by the Customer.

8. Online ordering

To make purchases through the Books Market, it is necessary to access the online store at bookmarket.pt or place an order via Messenger. After accessing the online store, simply insert all the items you wish to purchase into the virtual shopping basket. You must follow all the purchase steps for it to be completed successfully.

The validation of the purchase order implies that the Customer has acknowledged and expressly accepts these General Conditions of Sale, available for consultation. The registered data constitute proof of the set of transactions carried out between Books Market and the Client.

The data contained in the invoice are the sole responsibility of the Customer. Once issued, the invoice cannot be reissued with changes.

When purchasing books sold on Books Market, the following payment methods are accepted:

9. Product availability

Order requests are valid for 15 (fifteen) days, unless the order is registered under a promotional campaign that defines a different period, and it is not possible to guarantee prices, discounts, promotions and offers beyond this period. . If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be returned in the form of a voucher, which can be converted into a bank transfer or used in a new order.

Books Market only processes an order placed by a Customer after confirmation of the respective payment, so the availability of the items cannot be guaranteed until the beginning of said processing. In the product sheet, the Customer finds the mention “Available” which means that at that moment there is stock available. The stock is only carried out after the order has been paid by the customer and confirmed by our services.

If there is unavailability of any product ordered, and after having contacted the supplier to inquire about the possibility of replacing the missing book, Books Market will contact the customer if the delivery period or the price of the item changes and the order will only continue after consent given by the customer.

In case of absolute unavailability of stock of the ordered product, and if it is not possible to propose to the Customer any product of equivalent quality and price, or if he has not given his consent to change the order initially placed, Books Market will reimburse the amounts paid by the Client, within a maximum period of 2 (two) business days after notification of the cancellation.

10. Delivery times

The value of postage varies depending on the items you order, the address and the selected shipping method. At the time of purchase, you are presented with the different shipping methods and respective values.

Books Market undertakes to ship orders as soon as possible, any delay in the shipment of items, given the estimated dates presented, does not entitle the Client to any compensation.

Every effort will be made to always meet the delivery deadlines, informing the Customer if there is any difficulty in complying with them, in which case the option of terminating the contract will be available. By not exercising this right, the Customer assumes that he maintains interest in the order and that he consents to delivery beyond the aforementioned period.

The delivery times that we indicate are based on the date on which the order is confirmed and are presented on working days (Saturdays, Sundays and holidays do not count in the delivery time). In cases of force majeure duly enshrined in Portuguese law, Books Market cannot be held responsible for the delay in delivery.

Madeira and Azores Islands

Delivery by registered editorial mail: 4 to 5 working days.

11. Exchanges and returns

Right of Free Resolution

Having purchased an item on our website, you have a period of 14 days to proceed with its return, from the receipt of the order, under the terms of the right of free resolution, provided for in Decree-Law no. 24/2014, of 14th of February. You can do so, as long as the conditions described in our Returns and Refund Policy are met.

12. Warranty for Consumer Goods

If the purchased product is defective, the Customer must report the situation to Books Market Customer Support, stating the order number and description of the defect.

In case of dispute, the Client may resort to an Alternative Consumer Dispute Resolution Entity.

13. Applicable Law

All purchases made on the Books Market are subject to Portuguese legislation.

To settle any and all conflicts arising from any contract entered into under these general conditions of sale, Portuguese law shall apply, and its courts shall be competent for the resolution of disputes or alternatively, as agreed between the Parties, the RAL entity(ies) which can be consulted at the following link:
